1. Agreement to Terms

By accessing or using The Weather Agency Graphics Platform ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and The Weather Agency, operated by Twin Cities Media Group LLC.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use this Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. User Accounts

To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. License to Use the Platform

Subject to your compliance with these Terms, The Weather Agency grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal or internal business purposes. This license does not include the right to sublicense, resell, distribute, or make the Platform available to any third party, or to modify, adapt, or create derivative works of the Platform's software or technology.

The Platform allows you to upload, submit, and store certain content including but not limited to:

You retain full ownership of any content you upload to the Platform. By uploading content, you represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize the use of such content, and that your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

By uploading content to the Platform, you grant The Weather Agency a limited, non-exclusive license to use, store, display, and process your content solely for the purpose of providing and operating the Platform's services to you. This license terminates when you delete your content or your account.

6. Exported Graphics and Media

The Platform enables you to create and export various types of media and graphics, including but not limited to:

You are solely responsible for reviewing all exported graphics and media before publishing, distributing, or broadcasting them. The Weather Agency makes no guarantees regarding the accuracy, completeness, or suitability of exported content for any particular purpose. You assume all responsibility for how exported graphics and media are used.

All weather data, forecasts, maps, overlays, and related information provided through the Platform are for informational purposes only. Weather data is sourced from third-party providers and may not always be accurate, complete, or current. You should always verify weather information independently before making any decisions based on it.

The Weather Agency is not liable for any losses, damages, injuries, or decisions made based on weather data or information displayed on or exported from the Platform. The Platform is not intended to replace professional meteorological services or official weather warnings.

9. OBS and Third-Party Integrations

The Platform may offer integrations with third-party software and services, including but not limited to OBS Studio and other broadcasting tools. The Weather Agency makes no guarantees of compatibility, performance, or continued availability of any third-party integrations. Third-party services are subject to their own terms of service and privacy policies, and The Weather Agency is not responsible for the actions, content, or policies of any third-party service.

10. Subscription and Billing

Access to certain features of the Platform requires a paid subscription. Subscription fees are billed in advance on a recurring basis according to the billing cycle selected at the time of purchase. By subscribing, you authorize The Weather Agency to charge your designated payment method for all applicable fees. Failure to pay may result in suspension or termination of your account and access to the Platform.

Subscription fees are non-refundable. This includes, without limitation:

You may cancel your subscription at any time to prevent future renewals. Cancellation will take effect at the end of your current billing period, and you will retain access to the Platform until that period expires.

12. Intellectual Property

The Platform, including but not limited to its software, designs, layouts, features, branding, logos, documentation, and source code, is the exclusive property of The Weather Agency and Twin Cities Media Group LLC. All rights, title, and interest in and to the Platform are reserved. Nothing in these Terms grants you any right, title, or interest in the Platform other than the limited license expressly set forth herein.

13. Service Availability

The Weather Agency strives to maintain continuous availability of the Platform but does not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

The Weather Agency is not liable for any downtime, service interruptions, or any loss or damage resulting from the unavailability of the Platform.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, The Weather Agency, Twin Cities Media Group LLC, and their officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

USE OF THE PLATFORM IS AT YOUR OWN RISK. In no event shall The Weather Agency's total liability exceed the amount you have paid to The Weather Agency in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless The Weather Agency, Twin Cities Media Group LLC, and their officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

The Weather Agency reserves the right to suspend, restrict, or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Reasons for suspension or termination may include, but are not limited to, violation of these Terms, fraudulent activity, abusive behavior, or failure to pay. Termination of your account does not relieve you of any payment obligations incurred prior to termination.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in the State of Minnesota, and you consent to the personal jurisdiction of such courts.

18. Changes to These Terms

The Weather Agency reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
