The Weather Agency respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to notices of alleged copyright infringement that comply with the DMCA and are properly submitted to us.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Platform, please notify us as set forth below.
2. Filing a DMCA Notice
To file a notice of copyright infringement, please provide our designated agent with the following information in writing:
Your name and contact information: Include your full legal name, mailing address, telephone number, and email address so that we may contact you regarding your notice.
Description of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
Description of the infringing material: A description of the material that you claim is infringing and that you want removed or access to which you want disabled.
Location on the Platform: Information reasonably sufficient to permit us to locate the material on the Platform, such as a URL or other specific reference to where the infringing material appears.
Good-faith belief statement: A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Perjury statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
3. Repeat Infringers
The Weather Agency reserves the right to suspend or terminate the accounts of users who are determined to be repeat infringers of copyright. A repeat infringer is a user who has been notified of infringing activity more than once and/or has had content removed from the Platform more than once. We will act on this policy at our sole discretion.
4. Counter Notifications
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter notification to our designated agent. Your counter notification must include:
Your name, address, and telephone number
Identification of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or disabled
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which The Weather Agency may be found, and that you will accept service of process from the person who filed the original DMCA notice or an agent of such person
Your physical or electronic signature
Upon receipt of a valid counter notification, we may restore the removed content within 10 to 14 business days, unless the original complainant files a court action seeking a restraining order against the content provider.
